Cuando Mustaine se recuperó de su lesión creó el álbum "The system has failled" de 2004.
El grupo se rompió no solo por los problemas de Dave con su brazo, también terminaron de una manera poco cordial, llegando incluso a dedicarle un tema a Chris Poland titulado "Liar".

Megadeth estaba muerto y así iba a seguir. El disco estaba pensado para Mustaine en solitario pero ciertas obligaciones por cumplir con EMI le forzaron a hacerlo bajo el nombre de Megadeth.

De hecho tuvo que contratar a músicos de estudio y a... Chris Poland!!! Si si, extraño, pero así es Dave.
Pero... por que discutieron? pensaréis. Fácil de entender. Chris Poland vendió el material de Dave Mustaine para pillar heroína.
